TULARE COUNTY, California (KSEE/KGPE) – A man, 51, is guilty of a 2017 DUI crash that killed a baby and injured two women, according to the Tulare County District Attorney’s Office.
Timothy McDarment was convicted Tuesday of second-degree murder, gross vehicular manslaughter while intoxicated, felony hit-and-run resulting in death or injury and misdemeanor driving on a suspended license.
He’s been convicted of three DUIs in the prior to this one. The most recent incident happened on June 19, 2017.
At around 5 p.m., authorities say McDarment was driving fast in the area of Springville Avenue and Doyle Street, east of Porterville, when he tried to pass the victims’ car on the left by crossing over the solid double yellow lines.
As the victims were beginning a legal left hand turn into a driveway, McDarment’s Jeep struck the smaller car, crushing it and sending it spinning.
He fled the scene on foot, but was followed by witnesses and arrested by California Highway Patrol.
The one-year-old child was pronounced deceased. Two adult females also sustained injuries, one of which required “extensive” surgery and recovery.
Investigation showed that McDarment had a .13% BAC two hours after the crash.
He will be sentenced on Oct. 16, where McDarment faces up to 22 years to life in prison.
